COLLECTION AND PROCESSING OF PERSONAL DATA

This website uses Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses “cookies”, which are text files placed on your computer to help the website analyse how visitors use the site. The information generated by the cookie about your use of the website (including your IP address) will be transmitted to and stored by Google on servers in the United States . Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity for website operators and providing other services relating to website activity and internet usage. This website uses LinkedIn Insight Tag to track visitors and form completions from visitors from LinkedIn ads. We use this information on an anonymous and aggregate basis to measure advertising results. We use the Zendesk ticketing system, a customer service platform provided by Zendesk Inc, 989 Market Street #300, San Francisco, CA 94102, to handle customer requests. Data storage takes place exclusively within the EU. We use Zendesk to process your request quickly and efficiently. This constitutes a legitimate interest within the meaning of Art. 6 (1) lit. F DSGVO. In order to process your requests, necessary data such as e-mail address are collected in order to be able to answer your need for information. Zendesk has Binding Corporate Rules (BCR) that have been approved by the Irish Data Protection Authority. These are binding corporate rules that legitimise corporate data transfers to third countries outside the EU and EEA. Further details can be found here as well as in Zendesk’s privacy policy. If you have further questions, you can also contact Zendesk’s data protection officer directly at privacy@zendesk.com. If you contact us by e-mail, we will use the personal data you provide only to process your specific request. The data provided will be treated confidentially. Messages sent to us remain with us until you request us to delete them or the purpose for storing the data no longer applies. Mandatory legal provisions – in particular retention periods – remain unaffected. We have concluded an order data processing contract with Zendesk and fully implement the strict requirements of the German data protection authorities when using Zendesk.

Beyond the above named purposes, personal data is only collected and processed in the case that you expressly provide us with such on a voluntary basis, e.g., by using our online services. We will only capture and store information that enables communications to be specific and relevant to you, your company and your job. We may but won’t always collect full name, job title, job function, country of residence, company name, email address, direct line, business phone numbers, work address, LinkedIn and Twitter social media profile URLs. We will also store a history of assets downloaded from our website and BusyLamp events and webinars attended. This information is stored in Force24 and Pipedrive, a cloud CRM tool. We may also store this information in GoToWebinar.com if you register for a webinar hosted by BusyLamp. Data may be exported into spreadsheets for specific processing purposes, for example, printing an event delegate list to create name badges, but these will be permanently deleted after use so that data remains in secure databases only and not on spreadsheets on desktops for longer than one week. We take efforts to minimise the physical printing of PII data but in the case they are printed, papers are securely destroyed after use.

ENCRYPTION OF PERSONAL DATA

All entries with which you provide BusyLamp are transferred by using modern internet technology and are processed solely within the purpose intended. BusyLamp GmbH uses a transmission procedure which is based on an SSL Protocol (Secure Sockets Layer Protocol). This provides for an encryption of the entire data traffic between your browser and our server. This ensures that your data is protected against misuse by third parties while being transmitted.

COOKIES

BusyLamp employs cookies on certain webpages in order to provide you with more individual services. “Cookies” are small files which enable us to save information with regard to you, the user, to your PC or other terminal while you are using the services of BusyLamp.

BusyLamp services employ session cookies after your login (with your user name and password) which enable your identification for the duration of your session. These cookies expire automatically upon termination of your session. Additionally, BusyLamp services employ “permanent cookies” to record information about all users using these services. Permanent cookies are used to continually improve our product as well as our services. Permanent cookies do not contain any personal data. Your name, IP address etc. are not saved. BusyLamp does not create an individual profile of your user behaviour.

PROCESSING AND DISCLOSURE OF PERSONAL DATA, LIMITATION OF PURPOSE

Any personal data occurring from the use of BusyLamp services are processed and used solely for the processing of the contract in accordance with the respective laws and statutes applicable.For the purposes of direct marketing, including primarily email and digital advertising, we comply with Data Protection Regulation and ePrivacy Directives. For EU member states currently requiring it, we obtain explicit opt-in consent according to Art. 6 I a GDPR for eCommunications. We also seek consent for Canada and Australia. Consent is obtained via a check-box on website download forms (not pre-checked). A follow up confirmation email acts as a double opt-in, though this is only required for Germany, we collect it for other countries as best practice as it is not required for GDPR. Consent is stored in SharpSpring, a cloud marketing automation software. Consent will last for three years from the opt-in date or May 25th 2018, whichever is most recent, after which time we will ask if you would still like to receive marketing communications.

LEGAL BASIS FOR THE PROCESSING OF PERSONAL DATA

Insofar as we obtain the consent of the data subject for processing of personal data, Art. 6 I f GDPR serves as the legal basis.
When processing personal data which is necessary for the performance of a contract to which the data subject is a party, Art. 6 I f GDPR serves as the legal basis. This also applies to processing operations which are necessary to carry out pre-contractual measures.
Insofar as processing of personal data is necessary to fulfil a legal obligation to which our company is subject, Art. 6 I f GDPR serves as the legal basis.
If the processing is necessary to safeguard a legitimate interest of our company or of a third party and if the interests, fundamental rights and freedoms of the data subject do not outweigh the former interest, Art. 6 I f GDPR serves as the legal basis for the processing.

For EU Member States that do not interpret the ePrivacy Directive as requiring explicit consent for the purpose of marketing communications, and other countries such as the United States of America, we will seek to gain consent as a best practice measure but may use direct marketing without consent to communicate with you if you have voluntarily given your details to us in person, at an event, or downloaded a resource from our website. The legitimate interest according to Art. 6 I f GDPR is to promote our products, services and expertise.

We may use direct marketing to communicate with customers who have not given express consent as we have a legitimate interest according to Art. 6 I f GDPR to ensure customers are kept up to date with product updates, and additional products and services of relevance. We may also promote products and services to individuals from a third party database, as long as we have proof from the controller of that data that those individuals have consented to receiving relevant, third party communications.

We will never share any personally identifiable information (PII) data with any third party without explicit consent from you that your data can be used for that specific purpose on a specific occasion.

RIGHT OF ACCESS, RECTIFICATION, BLOCKING, ERASURE

You can unsubscribe permanently from communications at any time, or manage the type of emails you receive without penalty. Unsubscribed individuals will not receive direct marketing communications, except to send requested information. For example, if you have signed up to a webinar, then the joining instructions will be emailed to you even if you are unsubscribed.

REVOCATION OF YOUR CONSENT TO DATA PROCESSING

You can request at any time the data that we hold on you and may revoke consent regarding the collection, processing or use of your data with effect for the future at any time. Data subjects may also request a permanent deletion of their record, though this will also delete any consent preferences should they join the database again at a later date. If you choose to be deleted from our marketing system, Force24, it is not possible to be added again in the future.

RIGHT OF APPEAL TO THE COMPETENT SUPERVISORY AUTHORITY

As a data subject, you have the right to complain to the competent supervisory authority in the event of a breach of data protection law. The competent supervisory authority with regard to data protection issues is the State Data Protection Commissioner of the federal state in which our company is based. BusyLamp employs technological and organisational security measures to protect all data with which you provide BusyLamp against random or intentional misuse, loss, destruction or access by unauthorized persons. Our security measures are improved on a continuous basis according to the technological development.
